Agreement to Terms

By accessing and using the services of NextPoint League Tree Services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, customers, and others who access or use our tree care services.

Service Descriptions

NextPoint League Tree Services provides professional tree care services including tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are provided by trained and insured professionals in accordance with industry standards and local regulations.

Scheduling and Estimates

All service estimates provided are based on the information available at the time of inspection. Estimates are valid for 30 days from the date of issue. Final pricing may vary if conditions change or additional work is discovered during service delivery. We reserve the right to adjust pricing if the scope of work differs from the original estimate. Scheduling is subject to availability and weather conditions.

Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, checks, and major credit cards. For larger projects, we may require a deposit before beginning work. Any outstanding balance not paid within 30 days of service completion will be subject to a late fee of 1.5% per month. The customer is responsible for obtaining any necessary permits or approvals required for tree work on their property.

Cancellation Policy

If you need to cancel or reschedule your service, please provide at least 24 hours notice. Cancellations made with less than 24 hours notice may be subject to a cancellation fee. For emergency services, different terms may apply. We reserve the right to cancel or reschedule services due to unsafe weather conditions, equipment failure, or other circumstances beyond our control.

Liability and Insurance

NextPoint League Tree Services maintains comprehensive general liability insurance and workers compensation coverage. While we take every precaution to protect your property during service delivery, the customer acknowledges that tree work involves inherent risks. We are not responsible for pre-existing damage to underground utilities, septic systems, or other hidden infrastructure unless specifically noted in the service agreement. The customer is responsible for marking all underground utilities before we begin work.

Property Access

By scheduling our services, you grant NextPoint League Tree Services permission to access your property to perform the agreed-upon work. You are responsible for ensuring that our crew has clear access to the work area and for securing any pets during our visit. You must also notify us of any underground utilities, irrigation systems, or other potential hazards on your property before we begin work.

Warranty and Service Guarantee

We stand behind the quality of our work. If you are not satisfied with our services, please contact us within 7 days of service completion so we can address your concerns. Our warranty does not cover damage caused by weather events, disease, pests, or other factors beyond our control after service completion. Tree health cannot be guaranteed as living organisms are subject to various environmental factors.

Limitation of Liability

To the maximum extent permitted by law, NextPoint League Tree Services shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Galveston County, Texas. Each party shall bear their own costs and expenses. These terms shall be governed by the laws of the State of Texas without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically to stay informed of any updates.
